Disclosure Text for Personal Data Processed During the Real Estate Showing Process

According to Law No. 6698 on the Protection of Personal Data ("Law"), {{userName}} (hereinafter referred to as the "REAL ESTATE CONSULTANT") is defined as a REAL ESTATE CONSULTANT due to the fact that he processes your personal data. According to Article 10 of the Law, titled "Obligation to Inform," data controllers are obligated to inform the natural persons whose personal data they process on certain matters.

This text has been prepared by the REAL ESTATE CONSULTANT to ensure both regulatory compliance and transparency and accountability.

Definitions

According to Law No. 6698 on the Protection of Personal Data:

Personal data means any information relating to an identified or identifiable natural person; Processing personal data refers to any operation performed on data, such as obtaining, recording, storing, preserving, changing, rearranging, disclosing, transferring, acquiring, making available, classifying, or preventing the use of personal data, whether fully or partially automated, or non-automated, provided that it is part of any data recording system.

Relevant person: The natural person whose personal data is processed;

Data controller: The natural or legal person responsible for establishing and managing the data recording system, who determines the purposes and means of processing personal data.

The obligation to inform refers to the obligation of the data controller or their authorized person, during the collection of personal data, to inform the relevant persons about the identity of the data controller, the purposes for which personal data will be processed, to whom and for what purposes the processed personal data may be transferred, the method and legal basis for collecting personal data, and their other rights listed in Article 11 of the Law.

Relevant Person: During the real estate viewing process, I record the viewing process using the Project Presentation application. During this process; You, whose personal data I process, are defined by law as the relevant person.

Data Controller: [REAL ESTATE CONSULTANT] is the data controller responsible for determining the purposes and means of processing your personal data and for establishing and managing the data recording system.

Your Processed Personal Data, Processing Purposes, and Legal Grounds

• Your Identity (Name, Surname), Contact Information (GSM), Customer Transaction (Location Information)

o For the Purpose of Following and Conducting Legal Affairs (Recording Location Information)

 KVKK Article 5/2(e): Data processing is mandatory for the establishment, exercise, or protection of a right (In the event of a potential dispute, I must obtain and store your personal data to prove the location information).

In all these processes, your contact (GSM) information will be used to verify that I have shown you a location, based on Article 5/2(e) of the Personal Data Protection Law (KVKK), for the purpose of carrying out information security processes. (Sending a message to your mobile phone to confirm that the location has been shown will enable me to protect my rights in the event of a potential dispute.) Your transaction security (presentation date and time) information is automatically generated by the system I have defined. (The system I have defined also generates your personal data semi-automatically, through your identification to the system. However, your transaction security (presentation date and time) information is automatically generated by the system I have defined.

To Whom and for What Purposes May Personal Data Be Transferred During the Processes Specified Above

Your personal data may be transferred to the relevant authorities, without any obligation to disclose information and without seeking your explicit consent, upon request, in accordance with Article 28/1 of the KVKK.

In addition, in unforeseen circumstances, your personal data may be transferred to public institutions (administrative authorities such as Ministries) specified in the law, if requested and in cases clearly specified by law, within the purposes and limitations stipulated by law.

In addition to our legal obligations, which do not require an obligation to disclose information and do not require your explicit consent, your personal data processed in all the processes listed above is transferred to the company providing server services, Proje Sunuma, a sub-data processor with a data center located in Turkey, in accordance with the processing condition stipulated in Article 5 of the KVKK, Article 5/2(f): "The legitimate interests of the data controller, provided that the fundamental rights and freedoms of the relevant person are not violated."

Your Rights Regarding Your Personal Data

Data subjects are obligated to first communicate their rights regarding their personal data to the data controller.

According to the law, you can exercise your rights regarding your personal data:

a) To learn whether personal data has been processed,

b) To request information if your personal data has been processed,

c) To learn the purpose of processing your personal data and whether it is being used in accordance with its intended purpose,

ç) To know the third parties, both domestic and international, to whom your personal data has been transferred,

d) To request correction if your personal data has been processed incompletely or inaccurately,

e) To request the deletion or destruction of your personal data if the reasons requiring processing cease to exist,

f) To request notification of the actions taken pursuant to subparagraphs (d) and (e) to third parties to whom your personal data has been transferred,

g) To object to the analysis of your processed data, exclusively through automated systems, resulting in a detrimental outcome,

ğ) To request compensation if you suffer damages due to the unlawful processing of your personal data.

Your application must include:

▪ Your name, surname, and signature if the application is in writing;

▪ Your Turkish Republic ID number for citizens of the Republic of Turkey; if you are a foreigner, your nationality, passport number, or your ID number, if applicable;

▪ Your residence or workplace address for notification;

▪ Your email address, telephone, and fax number, if applicable;

▪ Your subject of the request.
